ENDING AN EMPLOYMENT CONTRACT
1 Ascertain if the employer is prepared to defend any wrongful dismissal proceedings;
2 Ascertain the cost of recruitment and training a replacement employee;
3 Begin a termination interview and inform the employee a serious issue exists and ask if they want a witness present;
4 Outline and explain the reasons for termination and produce any policies they have breached;
6 Refer to any previous counselling and warnings, when these took place, and of any diary notes such as commitments they have given to improve their performance;
7 Confirm in writing that the employment contract will end and the reason for termination, and ask them to sign the document and give them a copy. If they refuse, the witness should acknowledge that the termination took place, and
8 Keep notes of the interview in case the employee disputes the termination.
